These Terms and Conditions (“Agreement”) govern your use of the yourlocaleats.co.uk Website and/or App (the “Service”) provided by yourlocaleats.co.uk (“We”, “Us”, “Our”) for the purchase of food and beverages (the “Items”) from participating restaurants and eateries (the “Restaurant”). By using the Service, you agree to be bound by the terms set out in this Agreement.

1. Terms of Purchase

To use yourlocaleats.co.uk, you must ensure that you:
(i) have a functioning smartphone or device (“Device”)
(ii) have an active internet connection.

Once these conditions are met, the Service allows you to:
(i) view available Items for sale at local Restaurants,
(ii) purchase Items,
(iii) track the status of your order.

1.1 Payment Methods

When making a purchase through the Service, you may pay using credit or debit cards, Apple Pay, Google Pay, or PayPal. Payments are securely processed via an external PCI-certified server. Cash on delivery is accepted in certain circumstances, which can be withdrawn at any time.

1.2 Legal and Age Restrictions

By using the Service, you represent, warrant, and undertake that:
(i) You are legally capable of entering into a binding contract,
(ii) You are at least 18 years old,
(iii) You will use the Service for personal, non-commercial purposes,
(iv) You will not infringe upon third-party intellectual property rights.

It is illegal for anyone under 18 to purchase alcohol, and orders containing alcohol will not be accepted from persons under 18. Proof of age may be requested at the Restaurant or upon delivery.

2. Payment & Delivery Process

  • You must register and provide payment details to use the Service. Your details will be securely saved on an external PCI-certified server.
  • Payments will be processed via encrypted SSL connections. However, while yourlocaleats.co.uk will take reasonable security measures, you acknowledge that transmission over the internet is not completely secure, and any risk associated with data transmission is your responsibility.
  • On collection or delivery of your order, you may be required to show proof of your order number on your mobile device as identification. You are responsible for the safekeeping of this order number.

3. Delivery and Collection of Items

  • yourlocaleats.co.uk will procure the delivery of Items within reasonable industry timeframes after payment. The estimated delivery or collection time provided is not guaranteed and is subject to change.
  • yourlocaleats.co.uk complies with applicable laws concerning food safety, consumer rights, data protection, and other relevant regulations.
  • The relationship between you and yourlocaleats.co.uk is governed by English and Welsh law.

4. Cancellations, Disputes & Refunds

  • You can cancel or amend your order at any time until it has been accepted by the Restaurant. If you cancel or the Restaurant rejects the order, your payment will be refunded by your bank or card issuer, which may take up to 7 days.
  • In case of a dispute, you should first contact the Restaurant directly for resolution. If unresolved, you may contact yourlocaleats.co.uk within 24 hours of placing the order. We will make reasonable efforts to resolve the dispute.

5. Intellectual Property

  • All intellectual property rights related to the Service, including trademarks, logos, software, content, and other materials, are the property of yourlocaleats.co.uk or its licensors.
  • You do not acquire any ownership rights to these intellectual properties through the use of the Service.

6. Service Access and Availability

  • yourlocaleats.co.uk aims to provide uninterrupted access to the Service but does not guarantee continuous availability. We are not liable for any interruption in the Service or errors on the Website.
  • The Restaurant is responsible for providing accurate information regarding the Items, including pricing and descriptions.

7. Liability

  • yourlocaleats.co.uk is not liable for any loss of profits, sales, business, or data, nor any indirect or consequential damages arising from your use of the Service, unless such loss is due to our negligence or breach of these Terms.
  • Our total liability to you for any claim arising under this Agreement shall not exceed the price of your order.

8. Data Protection and Privacy

  • We are committed to protecting your personal data. Any information we collect from you will be processed in accordance with our Privacy Policy, which is available on our website.

9. Miscellaneous

  • yourlocaleats.co.uk reserves the right to modify these Terms at any time by posting updated terms on the Website or App. You may be required to accept the updated terms in order to continue using the Service.
  • If any provision of this Agreement is found to be unenforceable, the remaining provisions will continue to be valid.
  • This Agreement constitutes the entire understanding between you and yourlocaleats.co.uk and supersedes any prior agreements.

10. Governing Law

  • This Agreement shall be governed by and construed in accordance with the laws of England and Wales, and any disputes shall be resolved under the jurisdiction of the courts of England and Wales.

By using the Service, you confirm that you have read, understood, and agree to these Terms and Conditions.
